LIABILITY POLICY FOR COSOTRIP

1. Introduction
Cosotrip ("Platform") serves as a digital marketplace connecting Travelers ("Users") with Trip Organizers ("Hosts") for curated trips and experiences. This Liability Policy outlines the scope of Cosotrip’s responsibilities and clarifies the roles and obligations of Users and Hosts. By using the Platform, you acknowledge and agree to the terms in this Liability Policy.
2. Platform as an Intermediary
Cosotrip acts solely as an intermediary to facilitate connections between Hosts and Users.
The Platform does not:
- Organize, operate, or control the trips listed by Hosts.
- Guarantee the accuracy, safety, or quality of the services provided by Hosts.
All bookings, arrangements, and communications are made directly between Users and Hosts.
Cosotrip is not a travel agency, tour operator, or service provider and assumes no responsibility for service execution.
3. Assumption of Risk
Participation in trips and experiences involves inherent risks, including but not limited to:
- Physical injuries, illnesses, accidents or death.
- Unforeseen events such as natural disasters, political unrest, or travel disruptions.
Users and Hosts voluntarily assume these risks and agree that Cosotrip is not liable for any consequences arising from such risks.
By booking or listing a trip, all parties accept full personal responsibility for any outcomes arising during or after the trip.
4. Insurance Requirements
To mitigate potential risks, Cosotrip strongly advises the following:
A. For Users (Travelers):
Purchase independent travel insurance to cover:
- Medical emergencies, injuries, accidents or death.
- Trip cancellations, delays, or interruptions.
- Personal liability and theft.
B. For Hosts (Trip Organizers):
Secure liability insurance to protect against claims arising from:
- Accidents or injuries during trips.
- Property damage or other unforeseen events.
5. Host and Traveler Responsibilities
A. Host Responsibilities:
- Ensure that trips are conducted safely, professionally, and in compliance with local laws.
- Provide accurate descriptions of trips, including inclusions, exclusions, and risks.
- Respond promptly to queries, disputes, or emergencies during trips.
B. Traveler Responsibilities:
- Follow all safety instructions provided by the Host or local authorities.
- Disclose any medical conditions or physical limitations that may affect participation in trip activities.
- Use discretion and common sense during trip activities.
Travelers are solely responsible for assessing personal risk and fitness to participate. Cosotrip is not responsible for any mismatch between expectations and actual trip conditions.
6. Cosotrip’s Limited Liability
Cosotrip’s liability is limited to:
- Facilitating bookings and holding advance payments until transferred to the Host.
- Providing a platform for communication between Users and Hosts.
Cosotrip is not liable for:
- Injuries, disabilities, or deaths occurring during trips.
- Cancellations, delays, or changes made by Hosts.
- Losses or damages caused by third-party service providers (e.g., transportation, accommodations).
- Acts of God, natural disasters, political unrest, or other events beyond Cosotrip’s control.
Cosotrip, its founders, directors, officers, and affiliates are expressly indemnified against any claims arising out of personal, financial, or legal loss related to trip participation.
7. Dispute Resolution
Disputes between Users and Hosts must be resolved directly between the parties.
Cosotrip may mediate disputes at its discretion but does not guarantee a resolution.
In cases of fraud, serious misconduct, or policy violations, Cosotrip reserves the right to suspend or terminate accounts.
8. Limitations on Claims
Any claims against Cosotrip must be filed within six (6) months of the incident.
Claims are limited to the amount of advance payment held by Cosotrip at the time of the dispute.
Cosotrip’s maximum financial liability, if any, shall not exceed INR 5,000 or the platform fee received for the affected booking, whichever is lower.
9. Governing Law and Jurisdiction
This Liability Policy is governed by the laws of India.
Disputes will be subject to the exclusive jurisdiction of the courts in New Delhi, India.
10. Updates to this Policy
Cosotrip reserves the right to update this Liability Policy at any time. Users and Hosts will be notified of significant changes via email or platform notifications. Continued use of the Platform constitutes acceptance of the updated terms.
